Cuban Adjustment Act - Proposed AmendmentThis bill would amend the Cuban Adjustment Act to provide that any Cuban national who enters the US on a tourist visa, having represented that they intend to return to Cuba, would not be eligible for automatic refugee and residency under the CAA. Furthermore, anyone obtaining residency through the CAA shall lose their residency if they return to Cuba.

The US currently has in place a number of laws which makes it unlawful for US persons and companies to do business with the Castro regime or for the President to open an Embassy in Cuba until such time as the President determines that there is a democratic government in Cuba, or a transitional government. President Obama has not made these determinations, making many of the recently enacted regulations unlawful. There are few persons who have the legal standing to challenge such regulations.
